1. About X42 Monitoring New Zealand
X42 Monitoring New Zealand is the New Zealand sales and distribution operation for X42 products.
The X42 brand, products and associated intellectual property may be owned by or licensed from X42 Monitoring Pty Ltd and/or its related entities.
1081 Trading Limited operates the New Zealand sales, distribution and customer support channel.
2. Products and Product Information
We make reasonable efforts to ensure that product descriptions, specifications, images, features and other information displayed on our website are accurate and current.
Product images are provided for illustration and may vary slightly from the physical product.
Technical specifications may change from time to time as products are updated or improved.
We will not knowingly provide misleading or deceptive information about our products. New Zealand's Fair Trading Act applies to online sales and requires businesses to accurately represent the products they sell.
3. Pricing
All prices displayed on our New Zealand website are in New Zealand dollars (NZD).
Unless otherwise stated, prices include 15% GST.
Any applicable delivery charges will either be calculated at checkout or displayed as a flat-rate shipping charge.
The total price payable, including applicable shipping charges, will be displayed before you complete your purchase.
We reserve the right to correct genuine pricing or product information errors.
If an obvious error has resulted in an incorrect price being displayed, we may contact you before fulfilling the order to confirm whether you wish to proceed at the correct price.
4. Orders
When you place an order through our website, you are submitting a request to purchase the selected products.
Your order is accepted when we confirm the order and/or dispatch the products.
We may decline or cancel an order where:
- The product is unavailable
- There has been an obvious pricing or product description error
- We reasonably suspect fraudulent or unlawful activity
- We are unable to fulfil the order
- The order cannot reasonably be fulfilled for another legitimate reason
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled order.
5. Payment
Payment must be made using one of the payment methods available at checkout.
Payments are processed through third-party payment providers.
We do not ordinarily receive or store your complete payment card details.
6. Shipping and Delivery
We deliver X42 products throughout New Zealand.
Shipping may be:
- Calculated at checkout based on the delivery address and order; or
- Offered at a flat rate for eligible NZ deliveries.
The applicable shipping cost will be displayed before you complete your purchase.

Delivery timeframes are estimates unless a specific delivery timeframe has been expressly agreed.

7. Consumer Guarantees Act
Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under New Zealand law.
Where the Consumer Guarantees Act 1993 (CGA) applies, our products will be supplied in accordance with the guarantees required by that Act.
These include guarantees relating to:
- Acceptable quality
- Fitness for purpose
- Matching the description
- Safety
- Durability
- Delivery within the agreed or reasonable timeframe
If a product does not meet an applicable guarantee, you may be entitled to a remedy such as repair, replacement or refund, depending on the nature and seriousness of the problem.
8. Business Purchases
Where a product is purchased by a business for business purposes, the application of the Consumer Guarantees Act may differ.
Where permitted by law, we may agree with a business customer in writing that specified provisions of the Consumer Guarantees Act do not apply to a particular transaction.
Any such agreement must comply with the requirements of New Zealand law, including the requirement that the parties agree in writing and that contracting out is fair and reasonable.
Unless we have expressly agreed otherwise in writing, nothing in these Terms & Conditions should be interpreted as contracting out of the Consumer Guarantees Act.
9. Fair Trading Act
We are committed to providing accurate information about our products, pricing, availability, performance and features.
Nothing in these Terms & Conditions excludes or limits obligations or rights under the Fair Trading Act 1986 that cannot legally be excluded.
The Fair Trading Act prohibits misleading or deceptive conduct and false or misleading representations in connection with the supply of goods and services.
10. Installation
Some X42 products are designed for customer DIY installation.
Products must be installed and used in accordance with the applicable X42 installation instructions and product documentation.
Where installation is carried out by the customer or a third party, the installer is responsible for ensuring the installation is undertaken appropriately and in accordance with the applicable instructions.
Incorrect installation, modification, misuse or failure to follow installation instructions may affect the manufacturer's warranty, subject to any rights you have under applicable New Zealand law.
11. Product Performance
X42 products are designed to perform according to their published specifications and intended use.
Environmental conditions, installation, positioning, obstructions, signal conditions, tank configuration and other external factors may affect product performance.
Product performance claims should be considered alongside the applicable product specifications and installation requirements.
12. Warranty
X42 products may be supplied with a manufacturer's warranty.
Any applicable manufacturer's warranty operates in addition to your rights under New Zealand consumer law.

We do not accept returns or provide refunds where a customer has simply changed their mind, ordered the wrong product or no longer requires the product.
This does not affect any statutory rights or remedies available under New Zealand law.
If a product is faulty, defective, damaged, incorrectly supplied or otherwise does not meet an applicable consumer guarantee, please contact support@x42monitoring.co.nz.

14. Intellectual Property
The X42 name, logos, product names, product designs, technical information, photographs, graphics, documentation and other X42 brand assets may be owned by or licensed from X42 Monitoring Pty Ltd and/or its related entities.
You may not reproduce, modify, distribute, commercially exploit or otherwise use X42 intellectual property without appropriate permission.
Content created specifically for the New Zealand operation may be owned by or licensed to 1081 Trading Limited.
Nothing on this website transfers ownership of intellectual property to you.
15. Website Use
You agree to use this website lawfully and responsibly.
You must not:
- Attempt to gain unauthorised access to our systems
- Interfere with the operation or security of the website
